FOREIGNERS MARRIAGE IN TURKEY

As a significant touristic destination, people from a lot of countries visit  the republic of Turkey for honeymoons. Furthermore, as it does not require a visa from most other countries and since it has an easy-to-get visa for those countries that turkey requires visas from, this has led to an increase in foreigners getting married in turkey, which has made turkey a top destination for foreigners to marry in due to the ease of the paperwork procedure. Not to mention some other factors as the continuous increase of foreigners for different purposes such as residence, work, and migration.

Civil Marriage in turkey:

Civil marriage is a contract that is registered and recognized by the marriage directorate in municipalities and the institutions that are responsible for arranging such contracts. Civil marriage requires both contracting parties to be above the legal age (18 in Turkey), whereas  for those who are 16 and 17 years old to get married under certain conditions which are; the approval of the parents ( at least one of them). It is to be noted that according to Turkish law polygamy is strictly prohibited.

  • Ability to Marry: only those who are mentally healthy enough to make decisions concerning marriage, are permitted to marry. Thus, people with mental illnesses can not get married.
  • Endogamy: Marriage Between Relatives is strictly prohibited.
  • Already existing marriage: Monogamy is one of the essential principles of Turkish family law. A second marriage can not be initiated unless the first is terminated.
  • Waiting period: Married women whose marriage has been dissolved cannot marry before the expiration of three hundred days from the date of annulment .
  • Sickness: Certain medical conditions also can hinder marriage.

 Documents needed :

  • A bachelor's document or civil status registration from the husband and wife's consulate (Bekarlık Belgesi) which can be requested from the country's consulate, it must be translated and certified by the district office.
  • A copy of the residency permit of the contracting spouses.
  • Apartment Lease contract, a place of registration or any document proving housing in Turkey.
  • Passport translation and certification by a notary, provided that the passport has a stamp not more than three months old.
  • Some municipalities may require a document named "proof of non-change of name."
  • Written consent from the spouse's guardian if he/she is between 16 and 18 years old.
  • Eight personal photos of both spouses must be obtained (Vesikalık fotoğraf).
  • Reports of the spouses' medical examination (spouses can do it in one of the government or private hospitals).
  • Set an appointment with the Marriage Directorate (Nikah Sarayı).

Steps of marriage settlement  in Turkey:

Once  the spouses prepare all the necessary papers and documents mentioned above and translate and certify the needed documents, they must be taken to the Marriage Directorate of the municipality closest to the place where they live and fill out the marriage form and hand over the papers that have been prepared in advance, along with the payment of the fees to be paid to the relevant office .

Formalities
According to Turkish Marriage regulations, a Turkish national and a foreigner or two foreigners with different nationalities can be married by Turkish authorities.
Two foreigners of the same nationality can be married either by the offices of their own Country's Embassy or Consulate or by the Turkish authorities.


All marriages done by the Turkish authorities are subject to the relevant articles of the Turkish Civil Code and related regulations.

Whether they are Turkish or foreigners, Turkish relevant authorities do not conduct such marriages, unless the petitioners can provide their marriage licenses issued by the proper Civil Status Registrars of his or her own Country, that they hold the nationality of, respectively.

    Only civil marriages performed by authorized marriage officers are legally binding in Turkey.

Necessary documents for marriage:

  • Petition of marriage. To start the procedure in question, the groom and bride must file a petition of marriage. "Evlenme Beyannamesi"
  • Passport, Identification card, birth certificate.
  • Health certificate.
  • In order to marry, a medical examination is required. The examination may be performed in designated medical clinics determined by the Turkish Bureau of Marriages. Each marriage bureau will use different clinics for these tests. You will need to contact the marriage bureau of your choice for the addresses of these clinics. A report of medical examination includes applicant's blood type and results of blood tests for HIV, Hepatitis B & C, and Syphilis and indicates that the applicant has no contagious diseases.
  • 4 photos of the bride and groom.
  • Certificate of Capacity to Marry. (Single, divorce, widow or widowed.)

Steps of marriage in Turkey:

After the spouses prepare all the necessary papers and documents mentioned above and translate and certify the needed documents, they must be taken to the Marriage Directorate of the closest municipality to the place where they live and fill out the marriage form and hand over the documents that have been prepared in advance with the receipt of fees' payment then they shall be submitted all to marriage office.

After a while, the spouses will receive a call from the Marriage Directorate to set the date of the wedding.
